PENSION FUND MANAGERS.
In 1997 the Mexican pension system was transformed from a pay as you go to a
private scheme of individual capitalization (defined benefit – DB – to defined
contribution – DC -). The reform was implemented in order to face demographic
challenges and ensure the future financial sustainability of pensions.
Each worker owns an individual account in which contributions are mandatory for
the employer, the government and the employee.
The National Commission for the Pension System (CONSAR) is the regulator
and supervisor of Mexico’s pension system and its main objective is to regulate
AFORES.
AFORES are private financial institutions in charge of the administration and

By 2015, Mexican Afore pension fund managers will likely have amassed some
US$250 billion in assets, converting themselves into the largest pension managers
in Latin America. Long-awaited regulatory changes - permitting the Afores to
invest internationally beginning in early 2005 - signify one of the most long-
awaited and important opportunities for global money managers and brokerage
firms that seek to expand their business in the region.
The opening of the Afore market complements an extremely liberal set of
international investment rules for Mexico’s US$35 billion mutual fund industry
and plans for a liberalization of insurance-company portfolio rules to permit
allocations outside Mexico. Combined, the asset management marketplace in
Mexico could easily be halfway to a trillion dollars in just over a decade. (The

SIEFORES. MEXICAN PENSION FUNDS
While a world of possibility presents itself, the common predicament facing
portfolio management teams from the three industries (Afores, insurance
companies and mutual funds) will be understanding and managing risks in the face
of so many new investment opportunities. Relationship-building with global
advisors will become vital as the managers gain proficiency in previously
unexplored areas dealing with international asset allocation strategies, passive vs.
active investing, monitoring of outside advisors and daily positions, and hiring
custodians, just to name a few.
Also weighing on the era of change in the still-young pension industry is the
splitting up of core pension funds into sub funds with varied risk profiles, similar
to the multifunds system in Chile. Following the implementation of this system in
Mexico, the Afores may need to step up the outsourcing of security selection, as
has occurred in Chile, where allocations to international managers tripled within
two years of the launch of the multifunds system.

Billing.
R.G.' bills are normally prepared on the basis of time spent and the individual
lawyer's hourly rate. However, we are flexible in our fee structure, and will attempt
to tailor our fee arrangement and billing protocol to suit the particular requirements
of the client.
Invoices are normally submitted monthly, and may include expense items such as
travel, accommodation, long distance telephone calls and faxes. Most partners in
the Firm will charge an hourly rate of US$300 an hour. The hourly rate for
associates can range from US$80 up to US$250, depending on the individual
lawyer's experience.
Billing for litigation will suit the particular requirements of our clients.
